SUMMARY:

Definition of intimidation regarding rape and sexual battery. Presumes intimidation for the purposes of sexual battery, rape and other forcible sex crimes to exist, subject to rebuttal, when the sexual abuse takes place through the use of the accused's position as the victim's care provider or custodian.
