SB 777 Capital murder; criminal drug enterprise.

SUMMARY:

Capital murder. Provides that a willful, deliberate and premeditated killing upon the command of a person engaged in a continuing criminal enterprise is punishable as capital murder. A continuing criminal enterprise is defined by reference to the drug kingpin statute to require that the person occupy a position of authority in an organization of at least five persons involved in a series of felony drug violations and that the person derive substantial income or resources from the organization. An accessory before the fact (i.e., one who commands another to do the killing) may be prosecuted as well.
