SUMMARY:

Altering photographs or films in campaign advertisements to misrepresent candidates for public office. As engrossed, makes it a Class 1 misdemeanor to knowingly, willfully, and maliciously authorize the alteration of, or alter, a photograph or film for use in a campaign advertisement to convey false information about a candidate for public office. The advertisement must be published by, or offered for publication to, a news service, newspaper, magazine, television station, or cable service. A subsequent committee substitute revises the bill to create a civil right of action in favor of a candidate for public office if the outcome of an election is substantially affected by the willing, knowing and malicious alteration of a photograph used in a print ad or on television to convey materially false information with an intent to affect the election result.
