SUMMARY:

Hate crimes and offenses. Clarifies the Code sections punishing hate crimes and hate-motivated civil offenses to include the proviso that the offense exists notwithstanding the offender's mistaken belief about the race, ethnicity or religion of the victim. The bill also adds a minimum, mandatory sentence of 12 months for the offense of desecrating a place of worship if the offense is motivated by race, religion or ethnicity of the congregation. The bill also removes site restrictions on the crimes of cross-burning and swastika-placing, making it clear that such acts may not be committed on any public or private property.
