SUMMARY:
Administration of state government; policies or rules of practice regarding ex parte communications. Requires certain administrative and independent agencies and boards, as defined in the bill, to develop, adopt, and implement policies or rules of practice regarding ex parte communications made or attempted to be made to the agency or board in the course of its conducting cases or issuing case decisions. The bill defines an "ex parte communication" to mean "an oral or written communication not in the agency's or board's record regarding substantive, procedural, or other matters which could be reasonably expected to influence the outcome of the case or the case decision pending before the agency or board and for which reasonable notice to all parties is not given at the time of the communication." The bill establishes the deadline by which affected agencies and boards must develop, adopt, and implement such policies or rules of practice as the earlier of the date set forth in their final policies or rules of practice or January 1, 1998. The bill does not apply to agencies and boards which have such policies or rules of practice in effect on or before January 1, 1996.
