SUMMARY:

Driving intoxicated while an habitual offender. Punishes as a felony (1 to 5 years) the act of driving intoxicated while under the declaration of habitual offender and reverses the Court of Appeals decision in Bishop v. Commonwealth, holding that driving while intoxicated while an habitual offender does not, without more, "endanger the life, limb and property of another" and, thus, is a misdemeanor (90 days plus $2500 maximum fine) under the statute.
