SUMMARY:
Parenting arrangements. Modifies terminology to replace "joint custody" with "shared parenting," "custody and visitation" with "parenting arrangement" and "sole custody" with "sole parenting." The bill also adds a public policy statement to the Code regarding the joint rights and responsibilities of parenting, including statements that (i) where one parent is unable to act as guardian the sole rights and responsibilities of parenting devolve upon the other parent, (ii) each parent has a shared responsibility for the child's actual needs and (iii) a court may award custody to a person with a legitimate interest, other than a parent, only upon clear and convincing evidence of abuse and neglect by both parents.
