SUMMARY:

Distributions of collections from federal tax refund offsets. Requires the Department of Social Services to distribute amounts collected from federal tax refund offsets to satisfy non-AFDC past-due support obligations within 60 days following receipt of the offset or upon receiving notice that the unobligated spouse's share of the federal tax refund has been paid, whichever occurs first. This applies only to offsets of federal tax refunds payable jointly to a person liable for the past-due support payments and his or her unobligated spouse. The Department is required to establish procedures for the prompt refund of any incorrect offset amounts and the compensation of unobligated spouses for the payment of their shares. Currently, the Department holds money collected in these cases for up to six months, which is the maximum period permitted by federal law.
