SUMMARY:
Medical assistance services. Requires the Department of Medical Assistance Services to request, with all due haste, that the Health Care Finance Administration grant a revision to the existing waiver known as the Ventilator Dependency Program or Technology Waiver. The Department must include in this request mechanisms, which are cost effective, to extend eligibility for the waivered services for individuals whose families have been and are caring for them in their homes, under the following conditions: (i) the individuals are eligible for medical assistance services; (ii) the individuals would have been eligible for services through the waiver for the ventilator dependency program when under the age of twenty-one, if such individual had not been covered, as a dependent, under a policy of insurance or other health care benefit plan; and (iii) such individual would be eligible for home health services under the waiver at the time of application, if he had been institutionalized for a period of ninety days or more. The waiver request will not, if possible, require institutionalization of adult recipients and will take into consideration the cost savings to the Commonwealth of the family caregiving and the possible effects of continued family caregiving without assistance. The Department will report to the Senate Committee on Education and Health and the House Committee on Health, Welfare, and Institutions by November 1 of this year.
