SUMMARY:
Study; continuing the joint subcommittee examining real estate settlement practices. Continues the joint subcommittee established pursuant to HJR 210 (1996) to examine the real estate settlement practices of attorneys, title insurance companies, title insurance agents, and others in Virginia. Under the continuation resolution's provisions, the joint subcommittee would continue to examine the issues put before the HJR 210 joint subcommittee. Additionally, it would (i) monitor Virginia Supreme Court activities regarding any proposed unauthorized practice rule affecting real estate settlements, (ii) closely examine the legislative proposals put before the joint subcommittee in 1996 (including one requiring regulation of all settlement agents, and another prohibiting any Virginia Supreme Court rule restricting real estate settlements to licensed attorneys), and (iii) investigate issues associated with controlled business relationships in the real estate settlement industry.
