SUMMARY:

Bail. Clarifies that the current procedures governing arrest and bail hearings apply when the accused is arrested on a capias as well as a warrant and eliminates the authority for magistrates, judges and clerks to refuse to hold a bail hearing when a person is arrested on a warrant issued in another locality. Currently, in lieu of holding a bail hearing, the judicial officer may commit the accused to the arresting officer for transfer to the locality from which the warrant was issued. The bill requires the bail hearing to be held immediately and the accused will then be released or committed.

The bill is recommended by the Committee on District Courts
