SUMMARY:
Restrictions on use and sale of tobacco products. Adds public areas of drugstores and pharmacies to the list of public places where smoking is prohibited.
The bill also adds a subsection stating that no person shall sell tobacco products to an individual without photo identification proving his age. The bill gives the seller the option of not requiring identification of an individual that the seller has reason to believe is over 30 years of age.
The bill also provides that tobacco vending machines may be only operated in (i)restaurants, hotels or motels within certain express locations, (ii) private clubs, (iii) tobacco retail stores or (iv) designated places of employment. In all instances, the vending machines must be located within the plain view of and under the direct supervision of the proprietor or his designated agent. The provisions give the county attorney the authority to seek civil penalties for violations.
