SUMMARY:

Workers compensation; presumption as to definition of disease. Presumes carpal tunnel syndrome and hearing loss to be medically defined as diseases for purposes of claims for benefits under §§ 65.2-400 and 65.2-401 of the Workers' Compensation Act (relating to compensation for occupational diseases and ordinary diseases of life, respectively) unless such presumption is overcome by a preponderance of the evidence. The bill does not alter the claimant's burden of proof or exclude other ailments from potential coverage pursuant to §§ 65.2-400 and 65.2-401.
