SUMMARY:

Health maintenance organizations; continuing care facilities; prohibited practices. Prohibits HMOs from requiring Medicare-eligible enrollees to relocate from a continuing care facility to a skilled nursing facility outside the continuing care facility if (i) the continuing care facility is a certified Medicare skilled nursing facility and (ii) the continuing care facility agrees to become an HMO contracting provider. However, the facility will have neither the responsibilities nor the benefits of a participating provider. For example, the facility will not have to accept skilled nursing patients that are not facility residents. However, the facility may not advertise that it is a participating provider, and it will not be listed as one on any HMO's participating provider list filed with the State Corporation Commission.
