SUMMARY:
Workers' compensation; cost of living supplements for total incapacity and dependents of deceased. Allows a claimant or dependent to deduct the monthly amount paid for Medicare for purposes of determining the amount of combined disability benefit entitlements received. In the event that the disability benefit entitlement of a claimant or his dependents, in combination with benefits received under the Federal Old-Age Survivors and Disability Insurance, is less than 80 percent of the average monthly earnings of the claimant before disability or death, cost of living supplements are paid to the claimant or dependent.
