SUMMARY:
Railroad corporations; liability to employees; after-accident counseling services. Provides counseling services for railroad engineers and crew members involved in accidents resulting in a fatality or serious bodily injury. These services are to be provided by the railroad corporation or company. Each engineer or crew member involved in an accident resulting in a fatality or serious bodily injury shall be relieved from duty for a minimum of three days with compensation and applicable benefits. A railroad corporation or company does not have to provide compensation or benefits during this period to any engineer or crew member whose negligence caused the accident. Any engineer returning to duty shall, at his or her request, be assigned an assistant engineer for such time as necessary to guarantee the public safety or until it is medically determined that the engineer does not suffer from post-traumatic stress disorder. The State Corporation Commission is directed to promulgate regulations necessary for the implementation and enforcement of this bill.
