SUMMARY:

Health insurance; exemption from insurance regulation for certain long-term care prepaid health plans. Establishes contractual, financial responsibility and disclosure requirements for sponsors of pre-PACE and PACE long-term care prepaid health care plans. PACE is an acronym for Program for All Inclusive Care for the Elderly, a program that provides community-based services for elderly individuals and is intended to serve as an alternative to institutionalized care. Pre-PACE programs were exempted from state insurance regulation by the General Assembly in its 1996 Session. This bill amends the 1996 legislation, and it adds contractual, financial responsibility and disclosure requirements that include hold harmless provisions for the Department of Medical Assistance Services; an obligation to disclose to participants that the pre-PACE program is not insurance; and cash flow and liquidity requirements.
