SUMMARY:
Public safety employees and testing for blood-borne pathogens. Revises the procedure for blood-borne pathogen testing of public safety employees or other persons when such public safety employees and other persons are involved in an exposure-prone incident to allow magistrates (i) to hear disputes concerning refusal to give informed consent for such testing, (ii) to determine that an exposure-prone incident has occurred, and (iii) to order blood-borne pathogen testing if such incident has occurred. Present law requires a hearing before the general district court. The magistrate's decision may be appealed to the circuit court of the relevant jurisdiction.
