1997 SESSION
HB 2751 Freedom of Information Act; definitions.
Introduced by: Robert D. Hull | all patrons ... notes | add to my profiles
SUMMARY:
Freedom of Information; definitions. Specifies that the definition of "scholastic records" does not include results of schoolwide student elections which reveal specific vote tabulations and the identity of student candidates, and are therefore disclosable under FOIA. In Wall v. Fairfax Co. Sch. Bd., decided in 1996, the Virginia Supreme Court found that student election results requested by a high school newspaper editor were protected by the Freedom of Information Act; the election results did not fall within the Act's definition and exemption for "scholastic records."
