SUMMARY:
Student election results. Directs school personnel, upon request by a currently enrolled pupil or the parent of a currently enrolled pupil, to disclose the results of schoolwide student elections. If requested, the disclosure shall include specific vote tabulations and shall identify student candidates by name. Current law limits access to certain written pupil records to parents and certain school and law-enforcement personnel. School personnel do, however, now possess discretionary authority to disclose information about participation in athletics and other school activities and the winning of scholastic awards or other honors.
In Wall v. Fairfax Co. Sch. Bd. (1996), the Virginia Supreme Court found that student election results requested of a high school newspaper editor were protected by the Freedom of Information Act; the election results did not fall within the Act's definition and exemption for "scholastic records." The Court also noted that the current provisions of § 22.1-287 did not mandate disclosure of these election results.
