SUMMARY:

Development agreements. Allows New Kent County (described by population and location of interstate highway) to enter into binding development agreements. Such agreements shall promote the public health, safety and welfare and encourage economic development consistent with the comprehensive plan. The agreement shall be authorized by ordinance, shall be for a term not to exceed 15 years, and may be renewed by mutual agreement of the parties for successive terms of not more than 10 years each. If the property owner makes certain dedications, cash payments or public improvements, the property owner's rights under the agreement shall vest. If a property owner's rights have vested, neither any amendment to the zoning map for the subject property nor any amendment to the text of the zoning ordinance with respect to the zoning district applicable to the property which makes certain changes, such as eliminating or restricting, reducing, or modifying the use, the density or intensity of uses, shall be effective with respect to such property during the term of the agreement unless there has been a mistake, fraud or change in circumstances substantially affecting the public health, safety or welfare.
