SUMMARY:

Drug Control Act. Authorizes medical equipment suppliers to deliver to the ultimate consumer, pursuant to a prescription, solutions for peritoneal dialysis. A definition of dialysis solution is included which relates to peritoneal dialysis solutions and solutions for hemodialysis, "not to include any solutions administered to the patient intravenously." Presently, medical equipment suppliers are allowed to deliver hypodermic syringes and needles, medicinal oxygen and Schedule VI controlled devices, and Schedule VI controlled substances with no medicinal value that are used for the operation and cleaning of medical equipment. Solutions for peritoneal dialysis do not fall within any of these categories, although they are Schedule VI controlled substances, because these solutions do have medicinal value and are not used for the operation and cleaning of medical equipment. Peritoneal dialysis is a less intrusive method, used in patients with impaired kidney function, of cleaning toxins from the body and maintaining the balance of fluids, electrolytes, and acid-base, using sterile techniques for flooding the peritoneal cavity and gravity to remove the fluid with the toxins. This bill will remedy a barrier to the use of peritoneal dialysis for patients--the ultimate consumers.
