SUMMARY:

Aggravated malicious wounding, capital murder; murder of a pregnant woman; penalty.

Adds the willful, deliberate, and premeditated killing of a pregnant woman by one who knows that the woman is pregnant and intends to terminate her pregnancy to the list of capital murder offenses.

The bill creates a new crime for the willful and deliberate killing of a woman known to be pregnant and with the intent to terminate her pregnancy, without premeditation. This offense would be punishable by a term of 10 - 40 years.

Punishable as a Class 2 felony, a new classification of aggravated malicious wounding is cheated where the defendant caused bodily injury with the intent to maim, disfigure, disable or kill and the victim suffered the termination of a pregnancy.
