SUMMARY:
Aggressive driving; penalty. Authorizes the court, in its discretion, to elevate a defendant's charge of reckless driving to the offense of aggressive driving if any of the following aggravating factors are present: (i) driving a motor vehicle with a willful and wanton disregard for the life, limb, or property of another; (ii) driving a motor vehicle and brandishing a firearm with the intent to induce fear in another; or (iii) driving a motor vehicle in a threatening or intimidating manner with the intent to cause another motorist to run off the road or lose control of his vehicle. A penalty for this offense is established that includes both jail time and fines.
