Introduced by: William P. Robinson, Jr. | all patrons ... notes | add to my profiles
SUMMARY:
Deeds of trust on property exempt from levy or distress; refinancing. Stipulates that deeds of trust, mortgages or other sources of liens on property given in conjunction with refinancing are not void vis-?-vis property otherwise exempt from distress or levy under § 34-26 (identifying property exempt from creditor process). The debtor exemptions established by § 34-26 are currently inapplicable to deeds of trust, mortgages, etc., but the law is silent concerning the effect of these instruments when given in connection with refinancing.
