SUMMARY:
Bifurcated trial. Provides the court with a mechanism to deal with a case in which a jury cannot agree on punishment or the court, the attorney for the Commonwealth, and the defendant cannot agree that the court shall fix punishment. When the jury or the parties cannot agree that the court shall fix the punishment, then the court is required by this bill to dismiss the jury and impanel a new jury to ascertain punishment.
