SUMMARY:

Sentencing when defendant guilty of capital and noncapital felonies. Provides for a tripartite sentencing procedure when a defendant is convicted by a jury of both capital and noncapital felonies. The bill establishes a clear procedure which avoids the jury hearing evidence of unadjudicated prior bad acts during the sentencing for noncapital felonies unless the defendant elects to combine the sentencing.
