HB 2486 Criminal history records check; handguns.

SUMMARY:

Criminal history record check. Requires individuals who purchase handguns from nondealers to submit to a criminal history record check by the State Police and to accomplish the sale at a police station, sheriff's office or at a dealer's place of business, with the dealer handling the record check for a $20 fee. Violation of this provision is a Class 1 misdemeanor. The bill also creates a Class 3 misdemeanor for failure to post basic information on the laws governing handgun purchase, possession and use. The use of hunting and fishing licenses as identification for purchase of a handgun is disallowed, and inclusion of identifying information on the specific gun purchased is required to be included on the form to obtain a record check. Finally, the bill allows the State Police a 10-day grace period, instead of the next business day, when a delay is needed for further investigation on a prospective purchaser and allows the State Police to maintain handgun purchase records indefinitely (currently limited to 30 days).
