SUMMARY:
Employer references; immunity. Provides immunity for employers and former employers who provide truthful and documented information pertaining to the commission or attempted commission of violent criminal or civil offenses during the course of employment. This immunity for employers and former employers provides protection for statements made concerning the commission or attempted commission of violent criminal and civil offenses during the course of employment, unless the employee or former employee can prove clearly and convincingly that the evidence provided was untruthful. Employers and former employers are required to compile and maintain records concerning the commission or attempted commission of violent criminal and civil offenses that occur in the workplace, and any employer prior to extending an offer of employment must make a good faith effort to obtain this information.
