SUMMARY:
Wetlands and sand dunes permits. Establishes an expedited wetlands and sand dunes permit approval procedure for owners of private property whose property is threatened by or received damage from major storms. The emergency procedure could be instituted if a number of conditions are met, including (i) a determination by a three-member technical group representing the local wetlands board, the Marine Resources Commission (VMRC), and the Virginia Institute of Marine Science that there is the threat of or actual damage to real property from a storm, (ii) approval by the technical group of the appropriate placement of structures to protect property, and (iii) agreement by the applicant to the terms and conditions of the permit. If the property owner receives approval from the technical group, he would still have to submit to VMRC, within 10 days, an after-the-fact permit application which could contain additional terms and conditions.
