SUMMARY:

Parental consent for beepers on school property. Clarifies that local school boards and the governing boards of private schools are authorized to develop policies and regulations concerning the possession and use of beepers on school property, rather than each individual school as the Code now permits. This bill allows students to possess and use beepers upon public and private school property if the student's parent has given written consent to the student's principal. The parent may grant such permission for medical, health, safety, emergency, or other purpose approved by the parent.

A section has been added in Title 22.1 to reference the new provisions in the education title of the Code, facilitating easier access to the relevant law affecting students and schools. Under current law, persons convicted of possession or control of a beeper or similar portable communication device on the grounds of any public or private elementary, middle or secondary school are guilty of a Class 1 misdemeanor. An exception is made for teachers, safety and law-enforcement personnel, and others who use a beeper in a legal volunteer activity, trade, or business, or for medical necessity.
