SUMMARY:
Exemplary damages for persons injured by intoxicated drivers. Allows for recovery of punitive damages in an action arising out of a defendant's DUI violation in those cases in which the defendant was found to have unreasonably refused a blood-alcohol test upon proof, by means other than the BAC results, that the defendant was intoxicated, knew he was going to drive and was the proximate cause of the injury or death by his intoxication.
