SUMMARY:

Excursion trains. Authorizes the Department of Motor Vehicles to certify excursion trains operating within a county having between 50,000 and 55,000 people. Excursion trains are steam-powered trains that carry passengers for which the primary purpose of the operation of such train is the passenger's experience and enjoyment of this means of transportation, and do not, in the course of operation, carry (i) freight other than the personal luggage of the passengers or crew or supplies and equipment necessary to serve the needs of the passengers and crew, (ii) passengers who are commuting to work, or (iii) passengers who are traveling to their final destination solely for business and commercial purposes. Excursion trains must carry liability insurance of at least $10,000,000 and no owner or operator may also own or operate a regularly scheduled passenger train service. By local resolution, any railroad company which authorizes an excursion train to use its tracks shall be immune from liability for personal injury or wrongful death arising from the operation of an excursion train. This limitation of liability for railroad companies does not apply if such company commits gross negligence or authorizes train operations which are inconsistent with excursion train requirements. The operator of the excursion train is required to publish notice of the railroad company's limitation of liability on the tickets issued and on a sign near any passenger boarding area.
