SUMMARY:
Workers' compensation; costs. Authorizes an assessment against an employer or its insurer when the Virginia Workers' Compensation Commission or any court finds that either has, in bad faith, filed an application for a hearing. The bill authorizes the Commission to assess up to 10 percent of the total amount of the benefits accrued from the date the Commission determined the award should have been paid through the date of the award. This assessment is in addition to any other costs, fees or interests that may be levied against the employer or the insurer.
