SUMMARY:

Coal and mineral mining. Removes provisions in Title 45.1 (Mines and Mining), Chapters 14.2 (Mine Safety Act), 14.7 (Rights of Owners of Adjacent Land) and 18 (Refuse Piles, Water and Silt Retaining Dams), that pertain to mineral mining and enacts new chapters that apply only to mineral mining. The result is that separate but virtually identical laws will apply to coal mining and mineral mining. Certain substantive differences exist between current law and the new mineral mining provisions, including: the addition of a definition of an "approved competent person," who may perform some of the duties of a mine foreman; the expansion of a prohibition on the Department of Mines, Minerals and Energy personnel having any affiliation with a coal mining company, association or labor union to include mineral mining companies, associations and labor unions; a requirement that mineral mine foremen and independent contractors perform periodic safety inspections; and authority to transfer mineral mine operation licenses to successor operators. Also, several of the provisions of Chapter 18 currently apply only to coal mining, but identical sections will, under the bill, apply to mineral mining.
