SUMMARY:
Liability for the sale of alcoholic beverages to a minor. Creates a civil cause of action against a seller who illegally sells an alcoholic beverage to a minor who causes an injury or death. Under the new provision, the seller's unlawful sale will be deemed the proximate cause of the injury or death if the plaintiff can prove that (i) the acts of the minor resulted in injury or death, (ii) the minor consumed the beverage sold, and (iii) at the time the injury or death occurred, as a result of the consumption, the minor had a blood alcohol content of 0.08 percent or more.
