HB 2161 Small Business Environmental Compliance Assistance Fund.

SUMMARY:

Business compliance fund. Establishes the Small Business Environmental Compliance Assistance Fund. The Fund will be used to lend money to small businesses to purchase and install environmental pollution control and prevention equipment. The Department of Environmental Quality (DEQ), or its designee, will administer the Fund and determine which small businesses receive loans and the terms and conditions of the loans. The Fund will consist of general fund moneys, receipts from the loans, income from investments, and moneys which may be transferred from the Virginia Environmental Emergency Response Fund. The bill authorizes the use of moneys in the Virginia Environmental Emergency Response Fund to assist businesses in preventing practices which could result in pollution. However, loans cannot be made to small businesses that have been or are the subject of a DEQ enforcement action. Money cannot be transferred to the Fund until the Emergency Response Fund's balance exceeds two million dollars. The bill also exempts loans made from the Small Business Environmental Compliance Assistance Fund from the Administrative Process Act.
