SUMMARY:
Mental health: payment for guardians ad litem. Requires the Commonwealth to pay all the fees and court costs associated with proceedings for the appointment of guardians for persons who are alleged to be incompetent or incapacitated due to mental illness or mental retardation and are determined to be indigent. This change tracks similar language already in the Code for appointment of guardians in cases of protective services. Current state law allows courts to assess these fees as part of court costs or, in their discretion, to waive all fees and costs.
