SUMMARY:
Remediated property immunity. Provides persons immunity from enforcement and remediation actions under the state's water, air and waste laws and from citizen suits related to contamination that is the subject of an Agreement and Covenant Not to Sue obtained from the US Environmental Protection Agency regarding "superfund" National Priorities List property. The same limitations on liability are afforded subsequent property interest holders unless the subsequent property holder held an interest in the property prior to the issuance of the Agreement and Covenant Not to Sue. A person will not have immunity if the person violates the conditions of the Agreement and Covenant Not to Sue.
