SUMMARY:
Hunting injury; penalty. Requires individuals who injure another person while trapping or hunting with a firearm or bow and arrow to provide reasonable assistance to the injured party. In addition, the person who causes an injury or damages property while hunting or trapping is required to report the incident immediately to a law-enforcement officer. The failure to provide assistance to the injured person or immediately report the hunting-related injury is a Class 6 felony. The failure to immediately report damage to property due to the discharge of a firearm or bow and arrow while hunting is a Class 1 misdemeanor. A person who provides aid to the injured person would be protected from liability for civil damages.
The bill also authorizes game wardens at the scene of a hunting accident to arrest the person responsible for the hunting-related injury or property damage, without having to obtain a warrant.
