SUMMARY:

Trade and commerce; information infrastructure providers; restrictions on use of service; penalties. Permits the provider of an "information infrastructure service" to seek and recover monetary damages from any person who utilizes a provider's service and violates any express content or utilization restriction (i) which the provider has placed on the use of such service and (ii) of which such person has received notice prior to utilizing such service. For each violation, the provider may recover $500 or actual damages, whichever is greater, plus reasonable attorney's fees and court costs. As used in this bill, an "information infrastructure service" is any service furnished via the Internet, the World Wide Web, Usenet, bulletin board services, on-line services, or any similar telecommunications, cable or computerized network.
