1997 SESSION
HB 1559 Release of liens for support.
Introduced by: Clifton A. Woodrum | all patrons ... notes | add to my profiles
SUMMARY:
Release of liens for support. Allows a plaintiff in an action for support to release a support lien not made in accordance with current law which provides that such a lien can only exist if a judge orders docketing of a support order. This accomplishes two things -- liens created erroneously (docketed by the clerk without a court order) after the requirement of a court order can be simply released and liens properly created prior to that change in law (1977) can be released without the necessity of agreement of all the support recipients (including, presumably, children now over the age of 18). The changes are not applicable to liens filed by the Department of social Services.
