HB 1040 Civil immunity for teachers rendering health-related assistance.

SUMMARY:

Health-related assistance; limited civil immunity for public school teachers. Extends immunity to public school teachers (elementary and secondary) while rendering health-related assistance during an emergency or upon authorization of the child's parent or guardian, unless the acts or omissions were the result of gross negligence or willful misconduct. Modern medical technology assists many individuals in leading normal or near-normal lives who might, in previous eras, have died or have been confined to their homes, including many students with disabilities. Schools have federal and state statutory responsibilities for providing a free, appropriate education to all disabled students. In exercising this responsibility (as well as responsibilities for regular students), teachers must often provide health-related services, ranging from administering medications to suctioning for ventilator-dependent children and other sensitive activities. This bill addresses these situations.
