WHEREAS, motor carriers such as taxicabs, sight-seeing carriers, special or charter party carriers, limousines and executive sedans and the like, all provide valuable transportation services to the citizens of the Commonwealth; and

WHEREAS, the Commonwealth has an important interest in ensuring that motor carrier businesses are operating safe equipment, charging fair and equitable fares, and hiring qualified operators; and

WHEREAS, it is in the best interest of consumers for motor carriers to operate in a competitive marketplace where competitors may enter markets throughout the state without unnecessary hindrance or delay; and

WHEREAS, entry into the motor carrier marketplace is currently impeded by excessive documentation, lengthy hearings, and vague and outdated applicant requirements; and

WHEREAS, unnecessary regulation and a lack of uniformity between state law and local ordinances further hinder the successful operation of and ease of entry into the motor carrier marketplace; now, therefore, be it

RESOLVED by the House of Delegates, the Senate concurring, That the Department of Motor Vehicles be directed to study the regulation of motor carriers in the Commonwealth to ensure that motor carriers are providing safe, equitably priced, quality service, and to determine if unnecessary barriers block qualified competitors from entering the motor carrier marketplace.

All agencies of the Commonwealth shall provide assistance to the Department of Motor Vehicles for this study, upon request.

The Department of Motor Vehicles shall complete its work in time to submit its findings and recommendations to the Governor and the 1998 Session of the General Assembly as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents.
