973025114Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 18.2-319.1 as follows:
§ 18.2-319.1. Employer removal of safety equipment; penalties.
If an employer intentionally removes from any machinery or equipment any safety guard, safety device or safety warning provided by the manufacturer thereof except as provided in § 45.1-161.232 or in exceptions to such safety requirements set forth in the Mine Safety and Health Act, 30 U.S.C. § 801, et seq., or regulations published pursuant thereto, he is guilty of a Class 1 misdemeanor. If such violation results in an injury to person, the offender is guilty of a Class 6 felony.
2. That the provisions of this act may result in a net increase in periods of imprisonment in state correctional facilities. Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation is $0.
