Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 3.1-209.1 as follows:

§ 33.1-209.1. Solicitation of charitable contributions within certain highway rights-of-way; issuance of permits; penalty.

The Department shall, by permit, authorize groups and individuals to solicit money or other form of charitable contributions from occupants of motor vehicles within the right-of-way of highways in the primary and secondary system of state highways. Any such permit shall be issued without cost, shall specify the group or individual to whom issued, the period of validity, the location and times at which solicitations may be conducted, and such other conditions or limitations as may appear necessary or desirable.

It shall be unlawful for any person or individual to solicit money or other form of contributions from occupants of motor vehicles within the right-of-way of highways in the primary and secondary system of state highways or to stop or otherwise interfere with vehicular traffic within any such highway right-of-way by or for the purpose of soliciting money or any other form of contribution unless under a permit issued as provided in this section.

The Commonwealth Transportation Board may adopt additional regulations necessary to carry out the provisions of this section. Violation of any provision of this section shall constitute a Class 4 misdemeanor.
