A BILL to amend the Code of Virginia by adding in Article 2 of Chapter 14 of Title 10.1 a section numbered 10.1-1413.1, relating to solid waste information and assessment.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 2 of Chapter 14 of Title 10.1 a section numbered 10.1-1413.1 as follows:

§ 10.1-1413.1. Waste information and assessment program.

A. The Department shall institute a program for the accurate accounting of the amount of solid waste and sludge generated and disposed of in the Commonwealth. The program shall identify waste by the following categories, in addition to others the Board may deem appropriate: (i) municipal solid waste with subcategories of residential and commercial; (ii) construction and demolition debris; (iii) incinerator ash; (iv) sludge; (v) metallic waste; and (vi) other wastes, that shall include, at a minimum, subcategories for tires and batteries.

The program shall identify each category by: (i) amounts generated in state; (ii) amounts generated out of state but disposed of in the Commonwealth, either at a landfill, through incineration or by recycling; and (iii) the amount exported from Virginia. The source state shall be identified as shall the destination state.

B. The disposition of materials shall be reported by the following categories: (i) reused; (ii) recycled; (iii) composted; (iv) landfilled; and (v) combusted.

C. For materials identified in subsection B as recycled, the program shall identify quantities of the following materials: (i) newsprint; (ii) corrugated paper; (iii) office paper; (iv) mixed and other paper; (v) plastics; (vi) metals; (vii) glass; (viii) other organics; and (ix) other inorganics.

D. The Department shall prepare a report annually by July 1 that includes the data accumulated pursuant to this section and other solid waste disposal information the Department may have. The report shall be in an easily understandable format for use by the general public and shall be computer accessible. In addition to the information generated through subsections A, B and C, the Department shall include the identifying name, location, capacity and permit number of: (i) recycling facilities, including materials recovery facilities, transfer stations and processing plants; (ii) units used primarily for the combustion of solid waste, sludge or medical waste; (iii) landfills, including total capacity, remaining capacity and maximum daily capacity; and (iv) transfer stations.

E. All permitted facilities that treat, store or dispose of solid waste, sludge or medical waste shall provide the Department with such information as it requires to develop the program and complete the report required by this section.
