971680388Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-581.15:1 as follows:
§ 8.01-581.15:1. Liability of health maintenance organizations for medical malpractice.
Notwithstanding any other provision of law, in any action against a health care provider for medical malpractice in which it is alleged by a party that the health care provider (i) is a member of a health maintenance organization and (ii) at the time of the injury which forms the basis of the claim was acting in conformity with protocols established by the health maintenance organization, the health maintenance organization is a proper party and may be held jointly and severally liable.
