Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-878.3 as follows:

§ 46.2-878.3. Additional penalty for speeding while operating certain vehicles.

Except as otherwise provided in this article, operation of any motor vehicle in excess of the maximum speed limit shall constitute a traffic infraction. However, if it is subsequently found by the judge of a court of proper jurisdiction that any such violation was committed while operating a commercial motor vehicle as defined in § 46.2-341.4, he shall assess an additional penalty equal to the amount of the fine otherwise imposed plus one additional driver demerit point.

The provisions of this section shall not apply to buses or school buses.
