978156324Be it enacted by the General Assembly of Virginia:
1. That § 46.2-816 of the Code of Virginia is amended and reenacted as follows:
§ 46.2-816. Following too closely; penalty.
The driver of a motor vehicle shall not follow another motor vehicle, trailer, or semitrailer more closely than is reasonable and prudent, having due regard to the speed of both vehicles and the traffic on, and conditions of, the highway at the time. Any violation of this section shall be punishable as a traffic infraction. However, if it is subsequently found by the judge of a court of proper jurisdiction that such violation was committed while operating a commercial motor vehicle as defined in § 46.2-341.4, the penalty shall be double the amount of the fine otherwise imposed plus one driver demerit point more than otherwise assessable for violations of this section.
